By accessing or using BotLaunch ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any modifications.

2. Description of Service

BotLaunch provides a platform for creating, managing, and deploying Telegram bots with various modules and features. Our services include:

• Bot creation and management tools
• Modular functionality (143+ modules)
• Analytics and reporting
• API access (depending on plan)
• Customer support

3. Account Registration

To use certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

4. Acceptable Use

You agree NOT to use the Platform to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Distribute spam, malware, or harmful content
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to the Platform
• Interfere with the Platform's operation or security
• Use bots for illegal activities
• Scrape or collect user data without consent

Violation of these terms may result in immediate account termination without refund.

5. Subscription and Payments

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• Prices may change with 30 days notice
• Failed payments may result in service suspension

Cancellation

• You may cancel your subscription at any time
• Access continues until the end of the billing period
• No partial refunds for unused time
• Data may be deleted 30 days after cancellation

6. Intellectual Property

Our Property The Platform, including all content, features, and functionality, is owned by BotLaunch and protected by international copyright, trademark, and other intellectual property laws.

Your Content You retain ownership of content you create using the Platform. By using our services, you grant us a limited license to host, store, and display your content as necessary to provide the services.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services

The Platform integrates with third-party services (Telegram, Stripe, etc.). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services and make no warranties regarding their availability or functionality.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTLAUNCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless BotLaunch and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account and access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.
